The providers of Data Guardsman have arranged with Hiscox to be able to pay up to £250,000 against fines from the Information Commissioners Office for breach of the GDPR rules if you have applied the Data Guardsman system, and they have been wrong.

The insurance does not, however, cover businesses outside the United Kingdom, Internet Service Providers or Telecoms providers, NHS or Local Authority or other government bodies or similar organisations. They can still use the Data Guardsman system, but liability is limited in all such cases, and for all claims to the fees paid in the year of claim.

Ensure your website is compliant

According to the ICO, your website should have a layered privacy policy, at any point where you collect data that could be used to identify someone, i.e. all of your forms. This layered policy should be bespoke to your business.

Having a link to a page with your full 10 page privacy policy is not acceptable.

The 6 step process towards GDPR compliance

1. Log in to your own dashboard

Once you are signed up for Data Guardsman you get your own online dashboard.

Any of your team can log in to Data Guardsman, to work on any of the modules at any time, as long as they have a computer linked to the internet.

2. Select a module

You can select any module and work on it at any time. You don't have to complete a module once you start, you can save your progress and go back at a later date.

Start with the basics

We suggest that you start with the basics module so that you get a clear understanding of what constitutes personal data.

You can then work in a number of different ways:

1. Work through the modules in order and complete them, before going on to the next module.

2. Work on a module until you come to a task that might need some other imput that can only be done at another time. You can then work on different module and come back to it.

3. Work on the modules that you think deal with your biggest areas of risk.

4. Pick the modules that are easiest to deal with to give yourself a head start.
